Welcome to Bidlister. We are excited about your visit and we hope to provide you with a seamless platform to sell your goods and services. By using the Bidlister service platform, you agree to the following terms and conditions, these terms and conditions are in accordance to and recognized by International law. Before becoming a member of Bidlister, you must read and accept in accordance all of the terms and conditions stated herein this agreement. Although referred to as an “online auction” or auction site, Bidlister.com is not an auctioneer and instead provides the venue and platform for our members to list, buy, and sell items and services from anywhere and at anytime. We are not involved in the actual transactions between our members. While we strive to keep all of the information on our siteup to date and accurate bidlister.com (including our officers and employees) shall not be held liable for any damages, demands or claims in the event of a dispute between members.  Bidlister.com does not warranty and has no control over the condition, compatibility, safety, or legality of the items and service listed on the site.  Nor can we be held liable for inaccuracies, timeliness or completeness of our members’ items and services.                                                                                                                       4. CONDUCT AND CONTENT RULES FOR USING BIDLISTER.COM(MEMBERS)
Each user is assigned an account with full Accessibility to the site and any future content,including news and blogs. Each member registers a password and username and responsible for the security and confidentiality of their username and password.
Our main goal in collecting personal information is to provide you with a seamless, failsafe and customized experience.You agree we may use your information to prevent potential illegal activities, to provide the support and service for efficient use and transacting, and to keep you informed about all our new features and updates.
		A. While using our services you agree not to: Post, upload, email, transmit or any other form any content that 			is illegal, harmful, libelous defamatory, threatening, harassing, vulgar, obscene invasive of another’s           rights or scandalous.

		G. Modify, copy or distribute content from the site and Bidlister.com’s copyrights and trademarks.
		H. Interfere with the transaction or price of another user.
		I. Intentionally violate any applicable state, federal or international law.
		J. Collect information on members for any purposes including but not limited to solicitations, spam, chain    letters, or pyramid schemes.
		K. You also agree to that you will not use any sort of robots, spiders or scrapers to access our site for any  purpose or to bypass our headers and unlawfully access or infringe on this site.
		

5. Disclaimer of Warranties
Registered users (members) agree that the use of this service is at their sole discretion. The service provided is on an "AS IS WHERE IS" Basis Bidlister.com does not constitute a warranty of any kind expressly or implied, including but not limited to condition of item bought or sold, fitness for a particular purpose, non-infringement, it also includes warranties arising from usage of trade, or arising from any course or dealing. Bidlister.com makes no warranty of mechanical ability or condition of any item, equipment or machinery sold on its' site. Surplusport.com makes no warranty in regards to any item, machinery or equipment posting and we do don’t warrant that this site will meet any registered users requirement or transaction. We do not warrant any interruptions in service or any that the site will run error free without disruptions. We are not liable for any users and all users agree to use the web site at their own discretion.

6. Indemnification
Registered users will hold harmless, Bidlister.com and our officers, subsidiaries, brokers,agents, directors, partners,investors, employees and affiliates from any claim or demand,including any reasonable attorneys' fees made by any third party due to or arising out of the registered users use of this service,registered users violations of these terms,or violation by a registered user or any other person using the registered users' password, of any right of any person or entity.

7. Liability
Registered users agree to not hold Bidlister.com,or any of its officers, directors, subsidiaries,brokers, agents, investors, employees and affiliates,responsible for any direct, indirect, special or consequential damages arising out of the use or the inability to use the items and postings on this site.Bidlister.com and its' affiliates is not liable in any way or form to any failures of the sellers to deliver items and services, the buyers to pay for the items and service, the freight delivery, loading or damages arising from such said transactions. We are not responsible for any mistakes omissions, price changes, payment defaults,or defects in the service or termination of members account due to violation of terms.

8. User Termination
Bidlister.com reserves the right to terminate any registered user without cause at any time without any liability to registered user or third party At time of termination all outstanding commissions and fees will be due and are to be paid in full.

9. Notices
All notices will be sent via email to customer customerservice@bidlister.com or may be sent via mail to:

10. Resolution of Disputes
This agreement is governed by laws in the State of Minnesota and any claims or disputes will be handled and resolved by a court in Hennepin county, Minneapolis, MN. US. Any arbitration will be handled by one arbitrator in accordance and subject to the commercial Arbitration Rules of the American Arbitration Association.

Conclusion
Registered users agree to the above said terms and any disputes arising will be governed by the laws of the State of Minnesota and International law.We amend these terms at any time by posting amendments on the site.

	Our site requires registered buyers, sellers and people submitting job postings and notices to give us their contact and personal information so you can access  use the tools to proceed with your transactions.We do not get information from you unless you provide us with the information. We only use this information to assist you in your transactions. In general you can use and browse the site without sharing any information with us until a transaction is to be made and only then will personal information be needed solely to complete the transaction.

	Transaction information based on your account activity, buying, selling and hits you generate from your listings and we collect user comments in your feedback area.

	We in no way solicit, distribute or provide your information to any customer outside of the necessary information needed to complete a transaction. 
 
	We want to provide you with the utmost respect and confidentiality when you submit your information and will only be provided at your discretion to fulfill your customary business transacting needs. 
 
	You may also remove your information and/or listing at any time for any reasons you deem necessary and your information will be immediately terminated from our database.

Cases in which we would Share.

	With respect to your privacy the only case in which we would share your personal information would be to comply with Law Enforcement agencies relating to a criminal investigation or alleged illegal activity with a verified request. (No bad actors) In such a case we will disclose the relevant information for the investigation such as name, email address, city, state, zip code, IP address, user ID and user history and complaints related to your user ID. We may also share with VeRO program participants under confidentiality agreement in connection with illegal or unlawful activities such as piracy, fraud, intellectual property infringement, and other unlawful actions.  With respect to these cases we will not otherwise disclose your personal information to law enforcement, government agencies, or other third parties without a subpoena, court order, or other substantial similar legal procedure. 

	We may also share with service providers under contract who help us with business operations such as but not limited to bill collection fraud investigation, and reward programs.
	

Children’s Privacy
	Children under the age of eighteen are not allowed to use the Site without adult supervision.
